Overview
Welcome to Alta! The terms "we", "us" and "our" refer to Alta, a brand operated by Rochebrune Investments. Alta operates this store and website, including all related information, content, features, tools, products and services (the "Services"). Alta uses the Shopify platform to provide the Services.
These terms of service (the "Terms") govern access to and use of the Services. Purchases are also governed by our general terms of sale, which prevail in the event of any conflict.
By using our Services, you accept these Terms and our privacy policy. If you do not accept them, you must not use the Services.
Nothing in these Terms limits the rights you have as a consumer under French law, in particular the right of withdrawal and the legal guarantees of conformity and against hidden defects.
Article 1 — Access and account
To place an order, you must be of legal age and able to enter into a contract. A minor may only use the Services under the supervision of a parent or guardian.
To purchase our products, you may be asked to provide certain information (email address, billing, payment and delivery details). You agree to provide accurate, current and complete information.
You are responsible for keeping your account credentials confidential and for all activity on your account. You may not transfer or assign your account to a third party.
Article 2 — Our products
We strive to present our products accurately. Colours and appearance may however vary slightly depending on the screen and settings of the device you use.
We may change product descriptions or withdraw a product from sale at any time. These changes do not apply to orders already confirmed.
Article 3 — Orders
Ordering, payment, delivery, withdrawal and warranty terms are set out in our general terms of sale, our shipping policy and our return policy.
Purchases made on the website are intended for personal use and not for resale. Professionals wishing to purchase our illustrations may contact us for a quotation.
Article 4 — Prices
Prices are shown in euros, including all taxes (VAT included), excluding delivery costs. Delivery costs are shown before the order is confirmed. The applicable price is the one displayed at the time of the order.
We may occasionally offer promotions, governed by their own terms, which prevail over these Terms in the event of any conflict.
Article 5 — Delivery
Delivery times and the transfer of risk are governed by Article 6 of our general terms of sale and by our shipping policy.
Article 6 — Intellectual property
The Services, including the illustrations, visuals, texts, logos, the Alta brand and their arrangement, are the exclusive property of Rochebrune Investments or its licensors. They are protected by the French Intellectual Property Code.
You may use the Services for personal, non-commercial purposes. Any reproduction, display, modification or distribution, in whole or in part, without our prior written permission is prohibited and constitutes infringement.
Shopify's name, logo and trademarks are the property of Shopify. Other trademarks mentioned belong to their respective owners.
Article 7 — Optional tools
The Services may give access to tools provided by third parties, which we do not control. They are provided as is, and their use is subject to the terms set by their publishers.
Article 8 — Third-party links
The Services may contain links to third-party websites. We are not responsible for their content or for the products or services offered on them. Any complaint about them should be addressed to the third party concerned.
Article 9 — Relationship with Shopify
Alta is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Alta. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Alta, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Alta.
Article 10 — Personal data
Personal data collected through the Services is processed in accordance with our privacy policy. Some data may also be processed by Shopify, in accordance with its own privacy policy. As the Services are hosted by Shopify, your data may be transferred outside the European Union, subject to the safeguards provided by the GDPR.
Article 11 — Reviews and contributions
If you send us reviews, ideas or suggestions ("Contributions"), you grant us a free, non-exclusive licence to use, reproduce and publish them to promote and improve our Services, worldwide and for the legal term of copyright protection.
You warrant that your Contributions are genuine, do not infringe any third-party rights and do not contain any unlawful, defamatory or abusive content. We may remove any Contribution that breaches these Terms. Customer reviews are published in accordance with Article L111-7-2 of the French Consumer Code.
Article 12 — Errors and inaccuracies
The Services may contain errors or omissions, particularly in descriptions, prices or availability. We reserve the right to correct them at any time. If an obvious pricing error affects an order, we will inform you and you may either confirm the order at the correct price or cancel it with a full refund.
Article 13 — Prohibited uses
You agree to use the Services lawfully. In particular, you may not:
- infringe the intellectual property rights of Alta, Shopify or third parties;
- submit false or misleading information, or impersonate any person;
- harass, defame or harm any person;
- distribute viruses or any malicious code;
- reproduce, extract or resell all or part of the Services;
- collect other users' personal data;
- use robots, scraping or automated extraction tools, except as provided in Article 14;
- circumvent the security measures of the Services.
In the event of a breach, we may suspend or close your account, after notifying you except in cases of urgency or serious breach.
Article 14 — Automated agents
An "Agent" means any software acting autonomously or semi-autonomously on behalf of a person. An Agent may only access the Services if it identifies itself as such in its requests (user agent string "Agent/[agent name]"), does not pose as a human, does not bypass CAPTCHAs or access-limiting measures, and answers truthfully any question aimed at determining its nature. We may limit or refuse Agent access to the Services.
Article 15 — Termination
You may stop using the Services at any time and request deletion of your account at contact@altaateliers.com. We may suspend or terminate your access in the event of a breach of these Terms. Termination does not affect orders in progress, which will be fulfilled in accordance with our general terms of sale.
Article 16 — Warranties
Information available on the Services is provided for guidance only. We make every effort to ensure the availability and security of the Services, but cannot guarantee that they will be uninterrupted or error-free.
Products sold benefit from the legal guarantee of conformity (Articles L217-3 et seq. of the French Consumer Code) and the guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code), described in our general terms of sale.
Article 17 — Liability
We cannot be held liable for temporary unavailability of the Services, force majeure, or damage resulting from use of the Services contrary to these Terms.
This limitation does not apply to personal injury, gross negligence or wilful misconduct, or to the rights you hold under mandatory provisions of the French Consumer Code.
Article 18 — Severability
If any provision of these Terms is found to be void or unenforceable, it will be deemed not written, without affecting the validity of the other provisions.
Article 19 — Waiver and entire agreement
Failure to exercise a right under these Terms does not constitute a waiver of that right. These Terms, our general terms of sale and the policies published on the website constitute the entire agreement between you and us regarding the Services.
Article 20 — Assignment
You may not assign your rights and obligations under these Terms without our prior written consent. We may assign them, in particular if the business is transferred, provided that your consumer rights are not diminished.
Article 21 — Governing law and disputes
These Terms are governed by French law. In the event of a dispute, you may use the consumer mediator CM2C free of charge (49 rue de Ponthieu, 75008 Paris, France — www.cm2c.net). Failing an amicable settlement, disputes will be brought before the competent courts; consumers may in particular bring proceedings before the courts of their place of residence.
Article 22 — Changes to the Terms
The current version of these Terms is available at any time on this page. We may amend them; any material change will be notified to you before it takes effect. Orders remain governed by the terms in force on the day they were placed.
